1. About Swiss Wall

Swiss Wall is a ski and snowboard tracking, discovery, and social app developed and operated by Swiss Wall ("we", "us", "our"). You can contact us at hello@swisswall.app.

2. Eligibility

You must be at least 13 years old to use Swiss Wall. By using the Services, you confirm that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's permission.

3. Your Account

To access most features, you will need to create an account. You agree to:

• ·Provide accurate and complete information when registering.
• ·Keep your account credentials secure and not share your password.
• ·Notify us immediately at hello@swisswall.app if you suspect unauthorized access.
• ·Take responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of the Services

Swiss Wall is provided for your personal, non-commercial use only. You agree not to:

• ·Use the Services for any unlawful purpose.
• ·Post content that is abusive, threatening, defamatory, or otherwise objectionable.
• ·Impersonate any person or entity.
• ·Attempt to gain unauthorized access to any part of the Services.
• ·Use automated tools, bots, scrapers, or scripts to access the Services.
• ·Reproduce or distribute any part of the Services without our written permission.

5. User Content

You retain ownership of any content you create or upload through Swiss Wall, including GPS recordings, run notes, profile photos, and comments. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and distribute that content solely for the purpose of operating and improving the Services.

We reserve the right to remove any User Content that violates these Terms without notice.

6. Resort and Trail Data

Resort data, trail maps, lift information, and related content is provided for informational purposes only. We make no guarantees about its accuracy, completeness, or timeliness.

You are responsible for validating any information before relying on it for safety decisions on the mountain. Always follow the rules and guidelines of the resort you are visiting.

7. Safety Disclaimer

Skiing and snowboarding are inherently dangerous activities. Swiss Wall is a tracking and discovery tool — it is not a safety device, emergency locator, or substitute for proper training and equipment. You expressly acknowledge that:

• ·Using Swiss Wall does not reduce the risks associated with skiing or snowboarding.
• ·You voluntarily assume all risks associated with your skiing and snowboarding activities.
• ·Swiss Wall is not responsible for any injury, death, or property damage arising from your activities on the mountain.

Do not rely on Swiss Wall's GPS tracking for navigation in emergency situations. If you are in an emergency on the mountain, contact ski patrol or emergency services immediately.

8. Location Sharing

Swiss Wall includes an optional live location sharing feature. This feature is off by default and must be explicitly enabled by you. By enabling it, you consent to your location being shared with friends you have connected with who are at the same resort on the same day. You can turn it off at any time, and your location is immediately removed from our servers.

9. Intellectual Property

Swiss Wall, its logo, and all related branding are the exclusive property of Swiss Wall. All software, code, designs, and content created by Swiss Wall are protected by copyright and other intellectual property laws. You may not use our trademarks or branding without our prior written permission.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT RESORT DATA WILL BE ACCURATE OR COMPLETE. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SWISS WALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR YOUR SKIING AND SNOWBOARDING ACTIVITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €50 IF YOU HAVE NOT MADE ANY PAYMENTS.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time if we believe you have violated these Terms. You may delete your account at any time from Settings → Account → Delete Account.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. For significant changes, we will notify you via email or an in-app notification.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Turkey.
